Tradiify's core mission is to enhance lives through education. We facilitate the creation and sharing of educational content by anyone, anywhere (Mentors), and provide access to such content for learning purposes (Students).

Our marketplace model is designed to offer valuable educational resources to our users while maintaining a safe platform for all members of our community.

These Terms govern all your interactions with the Tradiify website or mobile applications.

If you choose to publish a course on the Tradiify platform, you are also required to adhere to the Mentor Terms.
Furthermore, information about our handling of personal data for both students and Mentors can be found in our Privacy Policy.

For users participating in Tradiify as part of their employer’s learning and development program, please refer to our Tradiify Business Privacy Statement.
These documents, along with any other Tradiify policies relevant to your usage of our Services, are incorporated into these Terms by reference.

12. How to Contact Us

1. Accounts

To engage in most activities on our platform, including purchasing and accessing content or submitting content for publication, you must have an account. When setting up and maintaining your account, it is essential to provide accurate and complete information, including a valid email address. You bear complete responsibility for your account and all actions taken on it, including any harm or damage resulting from unauthorized use. Therefore, it is crucial to exercise caution with your password. Account transfers or usage by others are strictly prohibited. Access to an account will only be granted upon providing sufficient information to verify ownership, except in cases of a user's passing, where the account will be closed.

1.1 Account Security

Sharing your account login credentials with others is strictly prohibited. You are accountable for all activities conducted under your account, and we will not intervene in disputes arising from shared login credentials. It is imperative to notify us immediately if you suspect unauthorized account usage or detect any security breaches by contacting our Support Team. We may request additional information from you to confirm ownership of the account.

1.2 Age Requirement

Users must be at least 18 years old to create an account and utilize our Services. If you are below the required age for consent to use online services but above the minimum age for consent in your jurisdiction, we encourage you to invite a parent or guardian to open an account for you. Account creation is strictly prohibited for those below the minimum age for online service consent. Accounts violating these rules will be terminated. Under our Mentors Terms, identity verification may be required before content submission authorization.

2. Content Enrollment and Lifetime Access

Under our Mentors Terms, when Mentors publish content on Tradiify, they grant Tradiify a license to offer the content to students. This means that we have the right to sublicense the content to enrolled students. As a student, when you enroll in a course or other content, whether it’s free or paid, you are granted a license from Tradiify to view the content via the Tradiify platform and Services, and Tradiify is the licensor of record. Content is licensed, and not sold, to you. This license does not confer any right to resell the content in any manner (including sharing account information with a third party or illegally downloading the content and sharing it on unauthorized platforms).

In legal terms, Tradiify grants you (as a student) a limited, non-exclusive, non-transferable license to access and view the content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes through the Services, in accordance with these Terms and any conditions or restrictions associated with the particular content or feature of our Services. All other uses are expressly prohibited. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any content unless explicit permission is granted in a written agreement signed by a Tradiify authorized representative.

While we generally provide a lifetime access license to our students upon enrollment in a course or other content, we reserve the right to revoke any access license to content at any time if we decide or are obligated to disable access due to legal or policy reasons. For example, if the course or other content you enrolled in is subject to a copyright complaint, or if it violates our Trust & Safety Guidelines, access may be revoked. However, this lifetime access license does not apply to enrollments via Subscription Plans or to add-on features and services associated with the course or other content you enroll in. For instance, mentors may choose to discontinue providing teaching assistance or Q&A services associated with the content. It's important to note that the lifetime access is granted to the course content but not to the mentors.

3. Payments, Credits, and Refunds

3.1 Pricing

The pricing of content on Tradiify is determined in accordance with the terms outlined in our Mentors Terms and our Promotions Policy. While we strive for consistency, the price of content offered on the Tradiify website may differ slightly from that offered on our mobile or TV applications. This discrepancy may arise due to the pricing systems and policies of mobile platform providers, particularly concerning the implementation of sales and promotions.

Periodically, we conduct promotions and sales for our content, during which specific content may be available at discounted prices for a predetermined duration. The price applicable to the content will be the price displayed at the time of your purchase (at checkout). Additionally, the price offered for particular content may vary based on whether you are logged into your account. Some promotions are exclusively available to new users.

When logged into your account, the listed currency is determined by the location specified during your account creation. Conversely, if you are not logged in, the price currency is determined by your current location. We do not offer users the option to view pricing in other currencies.

For students residing in countries where consumer sales are subject to use and sales tax, goods and services tax, or value-added tax, we assume responsibility for collecting and remitting such taxes to the relevant tax authorities. Depending on your location, the price displayed may already include these taxes, or they may be added at checkout.

3.2 Payments

By purchasing content on Tradiify, you agree to pay the associated fees, and you authorize us to charge your debit or credit card or process alternative means of payment (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees. Tradiify collaborates with payment service providers to offer you convenient payment methods in your country and to ensure the security of your payment information. We may update your payment methods using information provided by our payment service providers. For further details, please refer to our Privacy Policy.

When making a purchase, you agree not to use an invalid or unauthorized payment method. In the event of a payment failure resulting in continued access to the purchased content, you commit to remitting the corresponding fees to us within 30 days of notification. We reserve the right to disable access to any content for which we have not received adequate payment.

3.3 Refunds

If the content you purchased on Tradiify does not meet your expectations, we regret to inform you that we do not offer refunds. Once a purchase is made, it is considered final and non-refundable. Therefore, we encourage users to carefully review the content and course descriptions before making a purchase decision.

However, in exceptional cases where the content you purchased is disabled due to legal or policy reasons, you may be entitled to a refund beyond our standard no-refund policy. Additionally, Tradiify reserves the right to issue refunds at its discretion in cases of suspected or confirmed account fraud.

Please note that this no-refund policy applies to all purchases made on Tradiify, including Subscription Plan purchases.

We appreciate your understanding and cooperation in this matter. Should you have any questions or concerns, please feel free to contact our support team for further assistance.

It is your sole responsibility to be aware of and comply with such laws and regulations.

If you are a student, Tradiify's Services enable you to interact with mentors by asking questions and posting reviews of content you are enrolled in. In certain cases, mentors may request you to submit content as "homework" or tests. It is imperative that you do not post or submit anything that infringes upon the rights of others or violates applicable laws.

As an mentor, you have the privilege to submit content for publication on the platform and communicate with enrolled students. However, you must adhere to legal requirements and

You are solely accountable for any courses, content, or actions you undertake via the platform and Services, along with their repercussions. Familiarize yourself with all copyright restrictions outlined in the Mentor Terms before submitting any content for publication on Tradiify.

If we receive notice that your course or content violates the law or the rights of others, or if we determine that your behavior or content contravenes our Trust & Safety Guidelines or is otherwise unlawful, inappropriate, or objectionable (such as impersonation), we reserve the right to remove your content from our platform. Tradiify adheres to copyright laws, and further details can be found in our Intellectual Property Policy.

Tradiify maintains discretion in enforcing these Terms and our Trust & Safety Guidelines. We reserve the right to restrict or terminate your access to our platform and Services, or to ban your account, at any time and without notice, for any reason or no reason at all. This may occur if you violate these Terms, fail to settle any fees owed, engage in fraudulent activities, exhibit prolonged inactivity, encounter unexpected technical issues, or if law enforcement or government agencies request action. In such instances, we may delete your account and content, and prevent further access to our platforms and services. Even if your account is terminated or suspended, your content may remain available on the platforms. You agree that we bear no liability to you or any third party for the termination of your account, removal of your content, or blocking of your access to our platforms and services.

5. Tradiify’s Rights to Content You Post

The content you contribute as a student or mentor, including courses, remains your intellectual property. When you post courses and other content, you grant Tradiify permission to reuse and share it while retaining your ownership rights.

By submitting content, comments, questions, reviews, or providing suggestions for new features or enhancements, you authorize Tradiify to utilize and distribute this content across various platforms and media channels. This includes promoting it, making modifications, and incorporating it into marketing materials.

Legally, by submitting or posting content on Tradiify's platforms, you grant us a global, non-exclusive, royalty-free license (with the right to sublicense) to use, reproduce, adapt, modify, publish, transmit, display, and distribute your content (including your name and image) in any media or distribution methods. This encompasses sharing your content with other entities partnering with Tradiify for content syndication, distribution, or publication on alternative media. Furthermore, you waive any privacy or publicity rights applicable to these uses, to the extent permitted by law. You affirm that you possess all necessary rights, power, and authority to authorize Tradiify to utilize any content you submit, and you agree to such use without compensation.

It's important to review the content licensing terms outlined in the Mentor Terms, especially if you are an mentor on Tradiify's platform.

Dispute Resolution:

In the event of a dispute, Tradiify is committed to assisting users in finding a resolution. If informal methods fail, and you reside in the United States or Canada, your options are limited to pursuing the matter in small claims court or engaging in binding individual arbitration. It's important to note that you cannot bring such a claim to another court or participate in a non-individual class action against Tradiify.

10. Dispute Resolution

This Dispute Resolution section ("Dispute Resolution Agreement") applies specifically to residents of the United States or Canada. We encourage attempting resolution through our Support Team before considering formal legal action.

10.1 Dispute Resolution Overview:

Tradiify is dedicated to resolving disputes with users through informal means whenever possible. In case of an issue, both parties commit to diligently and in good faith striving for a fair and equitable resolution. However, should a third party's involvement become necessary, this agreement outlines the parameters for dispute resolution.

Both parties agree that any unresolved disputes, claims, or controversies ("Disputes") related to these Terms must be addressed solely through small claims court or binding individual arbitration. The right to a jury trial and to file a case in any other court is waived. Furthermore, both parties agree to bring claims against each other only on an individual basis, refraining from class or representative proceedings.

This agreement extends to agents, attorneys, contractors, subcontractors, service providers, employees, and all others acting on behalf of both parties. It is binding on respective heirs, successors, and assigns, and is governed by the Federal Arbitration Act.

10.2 Mandatory Informal Dispute Resolution Process:

Before initiating a formal claim, both parties must engage in an informal dispute resolution process. This involves sending a detailed Claim Statement outlining the dispute and proposing potential resolutions. A Claim Statement tolls the statute of limitations for 60 days from its receipt. Failure to complete this process constitutes a material breach of the Terms.

10.3 Small Claims:

Unresolved disputes may be brought to small claims court in Gautam Budh Nagar, Uttar Pradesh,India.

10.4 Arbitration:

As an alternative to small claims court, both parties have the right to resolve disputes through individual arbitration. The arbitrator has the authority to award the same relief as a court and must follow this agreement's terms. Any court proceedings are paused pending arbitration.

If there is a disagreement on arbitration matters, the arbitrator has sole authority to address such disputes. Courts have the authority to enforce this agreement's requirements.

If the designated arbitration organization is unable to administer arbitration, both parties will negotiate a suitable alternative. If no agreement is reached, a court may appoint an organization or individual to conduct arbitration.

10.5 General Arbitration Rules:

Arbitration proceedings will vary depending on whether the claim is pursued individually or as part of a Mass Arbitration. General arbitration rules outlined here apply, with exceptions for Mass Arbitration.

All arbitrations are before a single arbitrator. The initiating party must file an arbitration demand with the AAA. Disputes involving less than $15,000 USD in damages are resolved through non-appearance-based individual arbitration.

To initiate arbitration, the claiming party must send a letter describing the dispute to the American Arbitration Association Case Filing Services.

10.6 Mass Arbitration Rules:

Special rules apply if 25 or more claimants or their lawyers file or disclose an intention to file demands for arbitration against Tradiify. Each Mass Arbitration claimant must complete the informal dispute resolution process described in this Dispute Resolution Agreement. Counsel for claimants shall file a single Claim Statement for all Mass Arbitration claimants. The Mass Arbitration claimants must then follow a “bellwether procedure” described below.

10.7 Fees and Costs:

Each party will bear its own costs and attorneys’ fees in the event of a dispute. However, if arbitration is determined to be brought or threatened in bad faith, the court or arbitrator may award attorneys’ fees to the defending party.

10.8 No Class Actions:

Both parties agree to bring claims against each other only on an individual basis. Class actions, consolidated actions, or representative actions are not permitted. Nothing in this agreement limits the parties’ rights to resolve a Dispute by mutual agreement through a class-wide settlement of claims.

10.9 Changes:

If Tradiify changes this "Dispute Resolution" section after the date you last indicated acceptance to these Terms, you may reject any such change by providing Tradiify written notice of rejection within 30 days.

10.10 Improperly Commenced Arbitration:

If either party believes that the other has initiated an arbitration in violation of this Dispute Resolution Agreement, the party against whom the arbitration has been or will be initiated may seek an order from a court of competent jurisdiction enjoining the arbitration from being filed or continued, and awarding its fees and costs.

11. Updating These Terms:

We reserve the right to update these Terms periodically to clarify our practices or reflect new features or changes in our services. Any modifications or changes to these Terms are at our discretion. We will notify you of any material changes through prominent means, such as email notification or posting a notice within our Services.
